Tax Implications“Decree for the Promotion of the Manufacturing, Maquiladora and Exportation Services Industry Decree"published December 2, 2006.


       Below are English and Spanish versions of the Baker & McKenzie November 13, 2006 Bulletin summarizing the implications of the rules, under the decree issued December 2, 2006 to govern the maquiladora industry. Effective as of that date, this amendment to the Maquiladora Decree:
- repealed the decree that previously governed programs known as PITEX programs,
- expanded the coverage of the Maquialdora Decree to cover all programs previously issued as PITEX programs, and
- established unified provisions governing exportation promotion programs approved for companies under either decree in the past and those approved by the Mexican government in the future, all of which will now be referred to as Maquiladora programs or as "IMMEX" programs.
     As noted in this Bulletin, the amended Maquiladora Decree makes some changes in the applicable trade rules but preserves the existing tax treatment of maquiladora operations and extends the various elements of that tax regime to all operations conducted under Maquiladora / IMMEX programs.
